These terms apply to the public website. A signed proposal, order, subscription, or service agreement may add service specific terms and will control where it clearly states a different rule.
Using the website
You may use the website for lawful business information and enquiries. You must not interfere with the website, attempt unauthorised access, introduce harmful code, copy protected material, or use the site to mislead others.
Website information
Service descriptions, examples, timelines, availability, and prices on the website are general information unless a page clearly states otherwise. They are not a final quotation, promise, or contract for custom work.
Enquiries and quotations
An enquiry does not require either party to proceed. A quotation remains subject to its stated validity period, assumptions, exclusions, payment schedule, and customer responsibilities.
A service starts only after the required written approval and any required initial payment or access information are received.
Scope and changes
The approved proposal or service agreement defines deliverables, included revisions, dependencies, support, and completion conditions. Work outside that scope may require a separate quotation, schedule, or change approval.
Fees and payment
Fees, taxes, deposits, subscription periods, renewal terms, and payment dates are stated in the relevant proposal or order. Late payment may delay work, support, renewal, release, or continued service where permitted by the agreement and applicable law.
Customer responsibilities
- Provide accurate content, instructions, approvals, and authorised access
- Keep credentials secure and tell 4ITX promptly about suspected misuse
- Maintain lawful rights to supplied text, images, data, software, and accounts
- Review work and provide decisions within the agreed schedule
- Maintain any customer controlled licences, devices, accounts, and provider payments
External providers
Domains, hosting, email, cloud platforms, payment services, software, APIs, and other external services may be governed by provider terms, prices, limits, and availability. 4ITX cannot control provider outages, policy changes, account decisions, or discontinued features.
Intellectual property
4ITX retains ownership of its brand, reusable methods, templates, tools, and pre existing material. Ownership or licence rights for custom deliverables are defined in the applicable agreement and may depend on full payment.
The customer retains rights to customer supplied material and confirms that it may lawfully provide that material for the service.
Confidentiality and security
Each party should protect confidential information received for the service and use it only for the agreed purpose. Security measures reduce risk but no website, account, network, or cloud service can be guaranteed completely secure.
Suspension and termination
A service may be suspended or ended according to its agreement, including for nonpayment, security risk, unlawful use, provider restriction, or serious breach. The Refund and Cancellation Policy and any service specific agreement explain the financial effect.
Liability and warranties
Services are delivered with reasonable care within the confirmed scope. Any warranty, remedy, liability limit, or exclusion must be read with the applicable agreement and mandatory law. Nothing in these terms excludes a right or liability that cannot lawfully be excluded.
